Terms of Service

1. Acceptance of Terms

By accessing and using BeatWave, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on BeatWave for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modifying or copying the materials
  • Using the materials for any commercial purpose or for any public display
  • Attempting to decompile or reverse engineer any software contained on the platform
  • Removing any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirroring" the materials on any other server

3. Disclaimer

The materials on BeatWave are provided on an "as is" basis. BeatWave makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations

In no event shall BeatWave or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the platform.

Privacy Policy

1. Information We Collect

We collect information you provide directly to us, such as when you create an account, upload content, or contact us. This includes:

  • Username and email address
  • Password (encrypted)
  • Profile information and bio
  • Audio files and cover art you upload
  • Listening history and preferences

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our platform
  • Personalize your experience and recommendations
  • Communicate with you about updates and changes
  • Detect and prevent fraudulent activity
  • Comply with legal obligations

3. Data Storage & Security

Your data is stored securely using industry-standard encryption. We implement appropriate technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction.

4. Third-Party Services

BeatWave uses GitHub API for data storage. By using BeatWave, you agree to GitHub's Terms of Service and Privacy Policy. We do not share your personal information with third parties without your consent, except as required by law.

5. Your Rights

You have the right to access, update, or delete your personal information. Please contact us to exercise these rights.

Content Policy

1. Acceptable Content

BeatWave welcomes a wide variety of content. However, we ask that all uploads respect copyright and intellectual property rights of others. Content must not:

  • Violate copyright or intellectual property rights
  • Contain hate speech or discriminatory content
  • Include explicit instructions for illegal activities
  • Be sexually explicit or exploitative
  • Contain malware or harmful code

2. Copyright & Intellectual Property

By uploading content to BeatWave, you represent and warrant that you own or have the necessary rights to distribute the content. You grant BeatWave a worldwide, non-exclusive license to use, reproduce, and distribute your content on the platform.

3. DMCA & Takedown Requests

If you believe content on BeatWave infringes your copyright, please submit a DMCA takedown notice to our support team. Include specific information about the infringing content and your work.

4. Content Removal

BeatWave reserves the right to remove any content that violates this policy without notice. Repeated violations may result in account suspension or termination.

Artist Verification Policy

1. Verification Requirements

To receive an official verification badge, you must:

  • Have a public GitHub profile
  • Provide your GitHub username during signup or profile update
  • Have a minimum of 1,000 followers or 100,000 total plays
  • Maintain authentic and active profile

2. Verification Process

Our system will automatically verify eligible artists by checking their GitHub profile. Once verified, a badge will appear on your profile and tracks.

3. Verification Removal

We may remove verification if you violate our policies or if your profile becomes inactive for 6 months.

Storage & Technical Specifications

1. File Size Limits

  • Audio files: Up to 500MB per file
  • Cover art: Up to 10MB per image
  • Account data: Unlimited JSON storage via GitHub

2. Data Storage

All data is stored on GitHub using their API. Each account can store up to 1GB of data. When approaching the limit, we'll migrate to a new database partition automatically.

3. Backup & Recovery

We maintain regular backups of user data. In case of data loss, we'll attempt recovery within 30 days.

Account Management

1. Account Responsibility

You are responsible for maintaining the confidentiality of your encryption key and password. BeatWave will not be liable for unauthorized access to your account.

2. Account Termination

We may suspend or terminate your account if you violate these policies. Upon termination, your content may be deleted within 30 days.

3. Data Retention

After account deletion, your personal data will be removed within 30 days. Your uploaded content may remain on the platform unless explicitly requested otherwise.
